Thank you for using the site and/or services of Converdy!

We take your privacy very seriously, and this Privacy Policy explains the ways in which we collect, use, process, disclose, and protect information including personal information, relating to our site and services.

By visiting the Converdy Site or by using the services, you accept the terms and conditions of this Privacy Policy.

Yilps BV is the official Amsterdam based company behind the Converdy brand and platform, also referred to herein as “Converdy” “we”, “us”, or “our”. Yilps BV hereby is the company that is responsible for your information under this Privacy Policy (the “Data Controller”).

If you see an undefined term in this Privacy Policy (such as “Converdy platform”), it has the same definition as in our Terms of service.

This Privacy Policy may be amended at any time, with or without notice or notification. Therefore we recommend periodically reviewing this policy and suggest saving a local copy for your records.

The information we collect

We collect different types of information from or through the site and Converdy services. There are three general categories of information Converdy collects:

Information you give to us

When you create or sign up for a Converdy user account, when you download a software update, or contact us, we collect and store information into our databases. This is information such as your first name, last name, company name, email address, contact preferences, a password, and certain other information about you that may be required to provide the Converdy services or to be disclosed by you during your use of the services. Without this information, Converdy may not be able to provide all the requested services and therefore it is necessary for the adequate performance between you and Converdy and to allow Converdy to comply with her legal obligations.

Information that is automatically collected

When you use certain features of Converdy, and to offer you better user experience, we may collect:

  • Usage Information. Converdy collects information about your actions and interactions with the Converdy Platform such as feature usage, the pages you view, number of pages in use, design and the content of your pages.

  • Geo location Information. We collect information about your location as determined through data such as IP address / GPS of mobile devices. Note that most mobile devices allow you to control your location services in your device’s settings.

  • Cookies. Converdy uses cookies and other similar technologies, to personalize content and ads, to provide social media features and to analyze traffic. Converdy could also share information about your use of our site with social media, advertising and analytics business partners who may combine this with other information that you’ve provided to them or that they’ve collected from your use of their services.

  • Log Data. When you use Converdy, our servers may automatically collect log data and device information when you access and use the Converdy platform, also if you have not created an Converdy account or logged in. This log data may include, among others, but is not limited to, IP address, cookie data, the address of the web page you viewed before, hardware and software information, the date / time of your accessing the services, and browser signatures.

  • Payment information. Converdy collects information related to your payment transactions when payment information is required, for the adequate performance of the contract between you and Converdy. Converdy than will direct you to submit credit card information through a third-party such as Stripe.

  • Lead Data. You have the option of using the Converdy platform to, amongst others, create forms and solicit information from individual data subjects, also referred to as Lead Data. When you acquire information regarding your customers and then upload or let that information be uploaded to the Converdy platform, Converdy can store that on the Converdy servers. And since you choose which data you want to collect and process, you are acting as Data Controller under applicable laws, such as, but not limited to, GDPR law.

Information from third parties

If you choose to use third-party integrations, products or services, through the Converdy platform, these providers may allow us and our service providers to have access to and store additional information about your interaction, or your customer interactions, with those services and platforms as it related to use of the services. We do not control, supervise or respond for how the third parties providing your information process your personal data, and if you do not wish to have this information shared, do not initiate these connections.

We use our own or third-party web analytics services, such as Google Analytics, on our Services, to collect and analyze the information discussed above.

How we use information

The personal information we collect, use, store, and process about you allows us to provide, understand, improve, create, and develop the Converdy platform, our products, services, content and advertising, create and maintain a trusted and safer environment and comply with our legal obligations.

Also it:

  • Enables you to access and use the Converdy’s platform.

  • Provide you with Converdy’s product updates, security alerts, information about products you have purchased from us, upcoming events, contact you regarding Converdy’s and third-party products, services, surveys, promotions, changes to our terms, conditions, special events and other subjects that we think may be of interest to you.

  • Personalize, measure, and improve our advertising and customize the marketing, advertising and content you see (such as landing pages, advertisements, rewards, sweepstakes, contests, or other promotional activities or events sponsored or managed by Converdy or her partners), that may be of interest to you, also based on your preferences, and social media advertising through platforms such as Facebook or Google.

  • Provide customer service, so we can better respond to your request for information and provide you with more effective and efficient customer service.

  • Help us better understand your interests and improve Converdy’s products and services.

  • Operate, protect, detect and prevent fraud, spam, abuse.

  • Improve, and optimize the Converdy’s platform and experience.

  • We may use your personal information, amongst others including date of birth, to determine the age of Converdy’s Account holders and to verify identity, assist with identification of users, and to determine appropriate services for Converdy’s current and new users.

  • We may also use personal information for internal purposes such as auditing, data analysis, and research of your use to provide and improve Converdy’s products, services, and communications.

  • We will process this personal information to offer you products or services that may be of your interest, but if you don’t want to be on our mailing list, or other marketing communications, you can always opt out with the unsubscribe link in the last e-mail you received from Converdy or changing your notification settings within your account.

How we may share information

Converdy will not sell, rent, share, or disclose your personal data without first receiving your permission. We may use your personal data to generate aggregated data for internal use or sharing with trusted third parties, agents, subcontractors and other associated organizations on a selective basis. We will only share your information, including personal information, with these trusted third parties in accordance with applicable privacy legislation, and with our reasonable measures to ensure that the rules set forth in this Policy are complied with.

We will only share information with your instructions, for example when you initiate a connection with a third-party integration, necessary to provide you with a specific service or third-party website or application, or when you participate in promotional activities conducted by trusted Converdy partners or third parties, who only perform services on our behalf.

These third parties provide a variety of services to Converdy, including, without limitation, payment, payment processing, sales, customer service, marketing, advertising, analytics, research, shipping and fulfillment, data storage, security, fraud prevention, and legal services.

According to applicable law we may also use certain limited personal information (such as your email address) to share it with social media platforms, such as Facebook and Google, to drive traffic to our websites, generate prospects, or otherwise promote Converdy’s products and services. At any time, you may ask Converdy to stop using your data for these direct marketing purposes by sending an e-mail to us.

If the ownership of Converdy changes, because of a merger, acquisition, reorganization, sale of assets, or bankruptcy, we may transfer your information to the new owner so that the services can continue to operate. In such cases, your information would remain subject to the promises and commitments contained in this Privacy Policy, whereby Converdy will comply with applicable laws.

Your personal data may be stored and processed in any country where we work with local third-party service providers.

Your rights

We provide you with a number of choices to the information Converdy collects and use as described throughout this Privacy Policy, and also under the GDPR, you may be entitled to additional rights, including:

  • You can always login to your account and choosing to update some of your personal information in your Profile. Here you may also opt-out of receiving categories of service or marketing related messages that are not deemed by Converdy to be integral to your use.

  • You may require us to correct any mistakes in your information which we hold.

  • You may always object to processing of personal data concerning you for direct marketing.

  • In marketing email messages, you can always opt out by following the instructions located at the bottom of these email messages.

  • You have the right to demand that we restrict processing your personal data, under certain conditions, if you believe we have exceeded the legitimate basis, processing is no longer necessary, or believe your personal data is inaccurate.

  • Please note that we may still use and share certain information as permitted by this Privacy Policy or as required by law. You may for example, not opt out of certain service or transaction related emails.

  • By writing us an email via support@converdy.com, you may instruct us not to use, or reduce the information we have to contact you by postal mail, email, or phone regarding advertisements, services, products, promotions and events.

  • You also have the right to be forgotten by Converdy. You may exercise this right by e-mailing us at support@converdy.com. Converdy may use reasonable means to confirm your identity before granting any request for data so as to prevent the granting of fraudulent requests. We will comply with your request, after commercial obligations have been accomplished and in accordance with our user terms, to erase your personal data at no charge. This will be done within one calendar month by deleting your personally-identifiable data. Naturally, after we grant your request you will not have access to any Converdy services anymore, unless you open a new Converdy account.

Your responsibility under GDPR

If you are a Converdy user, then that probably means you are a business owner, or working for a business owner, using the Converdy software to sell services or goods to customers. With respect to the customer data that you provide to Converdy, Converdy is a data processor and will comply with its obligations under the GDPR; but with respect to your users or customers, you are a data controller, and when you have European Union users, you must ensure that you comply with your obligations as a data controller under the General Data Protection Regulation (GDPR); please consult an legal counsel for legal advice.

Children’s Privacy

We understand the importance of taking extra precautions to protect the privacy and safety of children under 16 using Converdy’s services. Therefore, our services are not permitted to children under 16 years of age. No one under age 16 should provide any personal information to us. If you are under 16 years of age, then please do not use or access Converdy’s services at any time or in any manner. We do not knowingly collect personal information from children under 16. Parents and guardians should supervise their children's activities at all times. If we learn, taking into consideration available technology, that we have collected the personal information of a child under 16, we will delete the information as soon as possible.

Security

Converdy takes appropriate measures to ensure that any personal data are kept secure. We also regularly monitor our systems for possible vulnerabilities and attacks. When your personal data is stored by Converdy, we use systems with limited access to your personal data to those who have a genuine business need to know it. We are continuously implementing and updating administrative, technical, firewall, data encryption and physical security measures to help protect your information against unauthorized access, destruction, loss or alteration.

We will strive to prevent unauthorized access to your personal data. Unfortunately, the transmission of information via the internet is not always completely secure. Although we will do our upper best to protect your personal data, we cannot 100% guarantee the security of your data transmitted to our software and website; any transmission is at your own risk. Once we have received your information, we will use strict security measures to try to prevent unauthorized access. We will also continue to enhance security procedures as new technologies become available.

How long we store your information

We will retain your information for the period necessary to fulfill the purposes outlined in this Privacy Policy and in accordance with our user terms and in connection with the performance of our contract, unless a longer retention period is required or permitted by law. We will hold the data for a reasonable time having regard to the nature of the personal data and the purpose for which it was collected.

Changes to this Privacy Policy

Converdy reserves the right to modify this Privacy Policy at any time in accordance with this provision. If we make any changes that we deem as “material” (in our sole good faith discretion), we will post the revised Privacy Policy on the Converdy website. We encourage you to periodically review this page for the latest information on our Privacy Policy. If you disagree with the revised version, you may cancel your subscription in accordance with our user terms. If you do not cancel your account, your continued access to or use of the Converdy services or products will be subject to the revised Privacy Policy.

Data Deletion

When you’re a user of Converdy you can always ask to have your data deleted. Simply e-mail us at support@converdy.com from your sign-up e-mail. To have your data deleted.
